Terms of Service

These Terms of Service ("Terms") govern your use of the AceMBLEx platform at acemblex.com (the "Service"), operated by Eastern School of Massage ("EMSOM," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

AceMBLEx is an online study platform designed to help massage therapy students prepare for the Massage and Bodywork Licensing Examination (MBLEx). The Service provides practice questions, mock exams, study games, courses, clinical scenarios, terminology tools, AI-powered tutoring, and progress tracking.

AceMBLEx is a study aid. We do not guarantee that using the Service will result in passing the MBLEx or any other examination. Exam outcomes depend on many factors including your overall study effort, program coursework, and test-day performance.

AceMBLEx is not affiliated with, endorsed by, or sponsored by the Federation of State Massage Therapy Boards (FSMTB). MBLEx is a trademark of the FSMTB.

2. Accounts

To access most features of the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or allow others to access your account.

You must provide accurate information when creating your account. You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's consent to use the Service.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or are inactive for an extended period.

3. Plans and Pricing

Free Tier

All registered users have access to a limited set of features at no cost, including a daily question limit and access to select study tools.

Free Trial

New accounts receive a 7-day free trial with full access to the platform. No payment information is required to start a trial. When the trial expires, your account reverts to the Free tier.

Pro Plan (Subscription)

The Pro plan is a recurring monthly subscription that provides full access to all platform features. The subscription renews automatically each billing period until canceled. You may cancel at any time through the Stripe billing portal; access continues through the end of your current paid period.

Premium Plan (One-Time Purchase)

The Premium plan is a one-time payment that provides lifetime access to all platform features. "Lifetime" means for as long as the AceMBLEx platform remains in operation.

Price Changes

We reserve the right to change pricing at any time. Price changes for subscription plans take effect at the start of the next billing period. Active subscribers will be notified of price changes in advance.

4. Payments and Refunds

All payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service. We do not store your payment card details.

Refund requests for Pro subscriptions may be submitted within 7 days of a billing charge by contacting us. Refunds for Premium (lifetime) purchases may be requested within 14 days of purchase. After these periods, payments are non-refundable.

If a payment fails or a subscription lapses, your account access will revert to the Free tier. Your study data and progress are preserved and will be available if you resubscribe.

5. Acceptable Use

You agree not to:

• Share your account credentials with others or use another person's account
• Attempt to access other users' data, accounts, or private information
• Copy, redistribute, or commercially exploit AceMBLEx content (questions, explanations, course materials, game content) without written permission
• Use automated tools, scripts, or bots to access the Service or extract content
• Attempt to reverse-engineer, decompile, or circumvent security measures of the Service
• Use the AI Chat feature to generate content unrelated to massage therapy education
• Submit abusive, harassing, or offensive content through the AI Chat or any other feature
• Interfere with the operation of the Service or impose unreasonable load on our infrastructure

Violation of these terms may result in immediate account suspension or termination without refund.

6. Intellectual Property

All content on the AceMBLEx platform — including practice questions, explanations, exam questions, course materials, game content, clinical scenarios, terminology definitions, and software code — is the property of EMSOM or its content licensors and is protected by copyright law.

Your subscription or purchase grants you a personal, non-exclusive, non-transferable license to access and use the content for your own educational purposes only. This license does not include the right to copy, distribute, sell, or publicly display any content from the platform.

7. AI Chat Disclaimer

The AceMBLEx AI Chat features (Atlas and Maya) are powered by third-party artificial intelligence technology. AI responses are generated dynamically and may occasionally contain inaccuracies. AI Chat is a supplementary study tool and should not be your sole source of information for exam preparation.

We do not guarantee the accuracy, completeness, or reliability of AI-generated responses. Always verify important information with your course instructors, textbooks, and official FSMTB resources.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, EMSOM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of income, or failure to pass an examination, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless EMSOM, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by temporary unavailability.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, Premium (lifetime) users will receive a prorated refund for unused service.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Service and contact us to close your account.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New Jersey.
